BREAKING: Tribunal Declares Kaduna Guber Election Inconclusive

Tribunal has declared Kaduna guber election inconclusive.

News ToGo reports that The Kaduna Governorship Election Petition Tribunal ruled the governorship election in the state, which took place on March 18, as inconclusive.

The tribunal, with a split decision of 2:1, declared the election inconclusive and instructed the Independent National Electoral Commission (INEC) to conduct a supplementary election within 90 days. This supplementary election will be held in seven wards across four Local Government Areas.

This platform had earlier reported that the Governorship Election Petition Tribunal in Kaduna rejected the second preliminary objection filed by Governor Uba Sani and the All Progressives Congress (APC) aimed at dismissing the petition lodged by the Peoples Democratic Party (PDP) and its candidate, Isah Mohammed Ashiru.

Governor Uba Sani and the APC, as the second and third respondents in the case, had argued that the petitioners had abandoned their petition. However, the Tribunal dismissed this motion, paving the way for the examination of the main petition.

The PDP is contesting the election of Uba Sani as the Governor of Kaduna State, citing alleged irregularities and electoral fraud, asserting that their candidate, Isa Mohammed Ashiru, emerged as the true winner.

Throughout the hearing of the petition, the PDP and Ashiru presented 24 witnesses and submitted evidence to substantiate their claims. At the conclusion of the hearings, all parties presented their final written addresses before the Tribunal.

Uba Sani’s legal team, led by former Attorney General of the Federation and Minister of Justice, Chief Bayo Ojo, SAN, argued that the petitioners had inadvertently helped demonstrate the legitimacy of his victory in the March 18 governorship election. They highlighted the admission of a key witness for the petitioner, Bonett Gwazah, a senior system analyst (SSA) in the VR/ICT Department of INEC in Kaduna State, as evidence of their victory.

BREAKING: Falana Reacts After CTC Exposed Appeal Court's Suspicious Judgment That Sacked Kano Governor

Femi Falana, a Senior Advocate of Nigeria (SAN) has reacted to the release of the Certified True Copy (CTC) of the Court of Appeal’s judgment on Kano State election.

News ToGo reports that the CTC affirmed the election of Abba Yusuf as the governor of Kano State.

People noticed discrepancies in the judgment. Those discrepancies were contrary to the initial pronouncement by the chairman of the three-man panel, Moore Adumein. Adumein upheld the tribunal’s judgment declaring Nasiru Gawuna of the All Progressive Congress (APC) as the winner.

In the CTC, signed by the three justices, the appellate court awarded a cost of N1,000,000 in favor of the New Nigeria People’s Party (NNPP). The APC was to pay the cost.

Falana highlighted the contradictory nature of the judgment. He quoted it, “I will conclude by stating that the live issues in this appeal are hereby resolved in favor of the 1st respondent (APC) and against the appellant (Governor Abba Yusuf).”

The court continued, “In the circumstances, I resolve all the issues in favor of the appellant (NNPP) and against the 1st respondent (APC). Therefore, I find no merit in this appeal, which is liable to be and is hereby dismissed.”

In the final line of the judgment, the court set aside the tribunal’s judgment that removed the governor.

Reacting to the confusion, Falana criticized the development, describing it as scandalous to the integrity of the judiciary. Furthermore, he questioned the court’s decision to penalize millions of voters for mistakes made by INEC officials.

Falana said, “You will be surprised if I show you the judgment of Kano. That one was almost scandalous. To my utter dismay, the majority judgment upheld the appeal, set aside the judgment of the lower court, and awarded cost in favor of the governor that was removed by the lower tribunal, contrary to the impression that was given out there,”

“The main judgment of the Court of Appeal has confirmed that the judgment of the lower court is wrong and has set it aside in writing and granted all the relief sought by Governor Abba. So many contradictions that the court can no longer explain,” he added.
